Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period expires fourteen days after the day on which you, or a third party designated by you other than the carrier, acquire physical possession of the goods. If multiple goods ordered together are delivered separately, the period starts when the last goods are received. If goods are delivered in several lots or pieces, it starts when the last lot or piece is received.

To exercise the right, inform us - Walter Palm, trading as Fashion Kontor / Bags Kontor, Königsplatz 27, 91126 Schwabach, Germany, email bagskontor@gmail.com, telephone +49 151 41469775 - of your decision through an unequivocal statement, for example a letter sent by post or an email. You may use the Model Withdrawal Form, but it is not mandatory.

You may also use the continuously available electronic function labelled “Withdraw from contract” on our website. After activating “Confirm withdrawal”, you will receive immediate confirmation on a durable medium. Use of the function is optional and does not restrict other withdrawal methods.

To meet the deadline, it is sufficient to send your withdrawal communication before the period expires.

Effects of withdrawal

If you withdraw, we will reimburse all payments received from you, including delivery costs except additional costs resulting from your choice of a delivery method other than our least expensive standard method, without undue delay and no later than fourteen days after receiving your withdrawal notice.

We will reimburse using the same payment method as the original transaction unless expressly agreed otherwise, and you will not incur reimbursement fees. We may withhold reimbursement until the goods are received or you provide evidence of sending them, whichever is earlier.

Return the goods without undue delay and no later than fourteen days after informing us, to the return address we promptly provide. Depending on the manufacturer, the address may be in Germany or another EU Member State, particularly Italy. Do not send goods to a manufacturer without instructions. Delay caused solely by our failure to provide the necessary return address promptly will not be held against you.

You bear the direct cost of returning the goods. You are liable for diminished value only where caused by handling beyond what is necessary to establish the goods' nature, characteristics and functioning.

Exceptions

The right does not apply, in particular, to goods not prefabricated and made on the basis of an individual consumer choice or clearly personalised, but only where the exception genuinely applies and was clearly disclosed before ordering.

Statutory withdrawal

The Withdrawal Instructions above apply to EU consumers. This policy supplements rather than replaces them. Unless expressly advertised, we do not grant an additional voluntary return right beyond mandatory law.

Return procedure and costs

Declare withdrawal within the statutory period by email, letter or electronic function. We will promptly provide the applicable return address and instructions. Because different partners fulfil orders, the address may differ from our business address and may be in another EU country, particularly Italy. Do not automatically return goods to Königsplatz 27 or a manufacturer without instructions.

For an ordinary change-of-mind withdrawal, the consumer bears direct return costs. Use secure, preferably tracked shipping and retain proof. Original packaging is not mandatory, but goods must be packaged safely. You may inspect goods as in a physical shop and are liable for diminished value only under the statutory conditions.

Refunds

Refunds follow the Withdrawal Instructions and are due no later than fourteen days after notice. For returned goods, we may wait for receipt or proof of shipment, whichever is earlier. Refunds normally use the original payment method. Original delivery costs for a partial withdrawal are refunded only where legally required.

Defective, damaged or incorrect goods

Contact bagskontor@gmail.com with the order number, a description and, where reasonably possible, photos. Where we are responsible under statutory conformity rules, we bear necessary remedy and return costs and may provide a label or reimburse reasonable postage. These rights are separate from and not limited by the fourteen-day withdrawal period.

Returns from outside the EU

Mandatory local rights may additionally apply. Customs paperwork may be required. Mark the parcel truthfully as returned goods and follow our instructions. Charges caused by incorrect return declarations may be passed on only to the extent permitted by law.
